CAP & BCAP Distance Selling Rules Consultation

CAP and BCAP have both published consultations on whether to remove the distance selling rules from their codes. The consultations both close on 13 January 2015.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCRs”) came into force in June this year (as noted in the IPA’s Legal Alert), amending the Distance Selling Regulations and giving CAP/BCAP the opportunity to review the distance selling rules in their codes. The current rules cover pre-contractual information requirements and post-contractual matters, reflecting the requirements of the Distance Selling Regulations. The rules do not cover advertising content though, hence the consultation on removing them altogether. The consultations make the point that, to the extent that distance selling ads are misleading, section 3 of the Codes would apply in any event. The consultations ask only two questions: dealing with the proposal to remove the rules on pre-contractual information and  post-contractual matters.
